Abstract

Analysis and Suggestions for an updated regulatory architecture, exemplary for core definitions and provisions.

The European Commission has presented its Digital Omnibus initiative, which besides many other regulatory frameworks shall update the GDPR. The European Commission suggests adapting the definition of personal data, as well as the requirements alongside article 6 GDPR. While even critical voices welcome the European Commission's intent, many stakeholders claim the suggested wording is either undercutting European data protection standards, or lacking clarity to be impactful at all.

This paper suggests to rethink GDPR's very architecture while analysing opportunities and risks that come along such significant change.

 

Alongside this pre-publication, the first update to the GDPR Model Draft was applied, which is now available in v1.1.
