I. Website and contact forms 

1. visiting the website 

Visiting any website involves the technically necessary (temporary) processing of personal data - in particular IP addresses. With the exception of such technically necessary information, you can visit the website without disclosing any further personal data. The Controller also has access to anonymized statistics on the use of the website. Here, information is aggregated on the basis of shortened IP addresses, such as the browser used, the duration of the visit, pages visited, country from which the website was presumably visited. 

2. contact forms 

The website offers you the opportunity to reach out to the Controller at various points using contact forms. Your IP address and the information requested via the form or provided by you will be processed.

3. email and telephone 

If you reach out to the Controller by email and/or telephone, the information you provide in the course of this communication will be processed. Please note that most telephones and network providers are configured in such a way that your telephone number is displayed in the event of a call and can therefore be processed. If you do not want this, please contact your network provider or telephone manufacturer. In accordance with GSM standards, you can also suppress the display of your telephone number per individual call by dialing the character string *31# followed by the telephone number you wish to call, regardless of any other provider specific or phone specific configuration.

II Client / Service relationship 

Personal data is also collected for the processing of your services requests and cases. A distinction can be made here between general and case-related information. 

1. general information 

General information is information that is required for the processing of the client / service relationship. In addition to your name, registered address and other contact details (e.g. email addresses or telephone and fax numbers), this also includes billing information - such as your account details. Billing-related data may also include further information, such as information regarding applicable insurances, such as your legal expenses insurance, any other third parties to whom the law firm can and should settle your claims directly, or your financial and personal circumstances, for example predominantly in connection with legal aid.

2. case-specific information

Personal data will also be processed in the course of handling your case(s). Which data will be concerned will of course depend on the individual case. Essentially, it will be information that you provide yourself. However, it is also conceivable that information will be provided by third parties, such as other parties to the dispute, courts or authorities. In the course of handling your case, it is also conceivable that personal data that identifies or makes identifiable data subjects other than you as the client will be processed. This may also result from information received by different sources, such as information provided by clients, courts or authorities.

Data pursuant to B.I.1. are processed in particular to provide the website and to improve the attractiveness of the website, in particular by optimizing the technical functionality and content preparation, as well as to ensure the security of the website and related services.

Data pursuant to B.I.2. are processed in particular to ensure the security of the website and the systems receiving messages, as well as for the purposes arising from the contact form or your messages.

Data pursuant to B.I.3. is processed in particular for the purposes resulting from each individual telephone call or your message.

Data pursuant to B.II.1. is processed in particular to process the respective case, in particular for administrative processing, contract initiation and contract processing.

Data pursuant to B II.2. is processed in particular for the processing of the respective case, in particular for the legal assessment and material processing or enforcement of rights.

Depending on the content of the message, data pursuant to B.II.3. will be processed either in accordance with the data pursuant to B.II.1. or data pursuant to B.II.2.

Data pursuant to B.I.1. is processed on the basis of Article 6.1 b) GDPR, insofar as this is necessary for the provision and security of the technical systems and thus for the initiation and / or execution of the contract. Insofar as the data is processed to optimize the content provided, this is also done on the basis of Article 6.1 b) GDPR, as a targeted, functional and comprehensible preparation and presentation of the content is part of an effective and relevant contract initiation. Insofar as the data is processed to maintain or continuously improve the security of the systems provided, the processing is carried out on the basis of Article 6.1 c) GDPR. 

Additionally and subordinantly, the processing of the aforementioned data is carried out on the basis of Article 6.1 f) GDPR, as the Controller has a legitimate interest in the functional and relevant design of the website, both technically and in terms of content.

Data pursuant to B.I.2. is processed on the basis of Article 6.1 b) GDPR, insofar as this is necessary for the provision and security of the technical systems and thus for the initiation and / or execution of the contract. Insofar as the data is processed to optimize the content provided or the functionality of the contact forms, this is also done on the basis of Article 6.1 b) GDPR, as a targeted, functional and comprehensible preparation, presentation and provision is part of an effective and relevant contract initiation. Insofar as the data is processed to maintain or continuously improve the security of the systems provided, the processing is carried out on the basis of Article 6.1 c) GDPR.

Data pursuant to B.II.2. are processed on the basis of Article 6.1 b) GDPR insofar as this is necessary for the proper fulfillment of contractual obligations within the scope of the client / service relationship. It is expressly pointed out that the necessity can often not be conclusively assessed during the processing of a case. Information that is supposedly irrelevant at the beginning can become highly relevant in the course of proceedings. In this respect, any information that becomes accessible to the Controller in the course of processing the case is assumed to be necessary.

II. Specific Remarks 

Article 15 GDPR: Please note that the provision of information regarding any processed personal data may be partially or completely, at least temporarily, impossible for legal reasons if and to the extent that, for example, the lawyer's duty of confidentiality precludes the provision of information.

Article 21 GDPR: Please note that your personal data is generally not processed on the basis of a balancing of interests. If the processing of your data cannot be based on Article 6.1 b) GDPR or Article 6.1 c) GDPR, you have the formal right to object to this processing. At present, however, currently only personal data are processes which are absolutely necessary for the provision of the service, so that an objection is most likely to be negative, as the existence of circumstances arising from your particular situation that prevent processing is highly unlikely in view of the specific processing.
